Yes I have! Wayne Martin probably hasn't seen it in an urban area, but it happens quite often in rural areas. It happens a lot with driveways and paths! It most often happens in places where people have used a path or drive way for years. A new owner comes along and wants to close it. Case goes to court and the new owner always loses.

AKA - squatters rights ~ when someone uses the property as their own over a number of years and then makes claim to it. If then uncontested and proof of possession can be made, it legally becomes theirs. ~ I have seen this happen a couple of times over the years.

I suspect it happens most often with unrecorded easements for access via an adjacent property.

During the years following the Bank of America caused recession assertive squatters were not uncommon. This tactic gave the appearance of legitimacy due to the overwhelming volume of abandoned real estate. 

It did however solve a problem for those who found shelter. Whether it  was solely for shelter or simply a strategy to live FREE on anothers real estate to save for a future purchase, these folks were problematic.

The sheriff gets there too soon to make this tactic practical today.

Many times, a lot of rural land boundaries are established in the wrong place.  Often this is not noticed until we survey the land for timber sales or other practices.

From this point forward it is up to a judge to determine which neighbor will win.

Not in my business practice, however one day I came home after being gone on a business trip to find my husband roto-tilled a line down our entire lot line. When I inquired he advised he had our yard surveyed and found out the neighbor was taking a good amount of our land.  We ended up planting Arbor Vitae's down the entire lot line (NO FENCES PLEASE) so as to keep a good relationship with the neighbor -- which we did. But for all practical purposes he could have (down the road) said he had been maintaining it for over 20 years and we didn't want to even entertain that idea.

I have never had any problem with regards to adverse possession; however, I did see a lady with a beard and the worlds smallest horse at a state fair.
