There is Nothing RUDE About Operating Per the Real Estate ContractThe other night in our office bull pen, there was a lively discussion about whether or not a Bristow-Gainesville Listing Agent should advise their sellers to deliver notice to their buyers when the financing contingency has expired.  You see, the way our local real estate contract works is that a buyer has a financing contingency, that sometimes includes the appraisal, and there is a certain amount of time for that financing to be approved.  Most financing contingencies would probably be about twenty-four to thirty days.  If they aren't voluntarily removed and are not called by the sellers, these contingencies continue up to settlement.Why would leaving a financing contingency in place be a big deal?  Well, if a buyer is ...

The Second Day of Spring in Bristow, VA 2018  Opening up my shades this morning and looking out of the bedroom window, I was not shocked to see the blanket of snow on the ground and trees.  Is it normal for Bristow, VA to have snow in late March?  Well, it's happened before, but is not an annual expectation.  Snow storms like this happen, and they can give more accumulation than you would think.  This particular snow event has left about five inches of snow so far.  Thank goodness, the driveway my husband shoveled a couple hours ago is still clear.  The snow falling midday isn't sticking last the stuff that fell in the wee hours of the morning.The one thing I always think about when it snows is my north facing driveway.  Having had ice a result of lingering snow that melts a bit from am...

Who Should Hold the Earnest Money if the Buyer is a Licensed Agent?Typically, in the Bristow-Gainesville real estate market, when a buyer writes a check for the earnest money deposit (EMD) to accompany the offer on a property, it is made out to the brokerage representing the buyer.  The buyer's brokerage will hold that EMD and release it as directed per the contract.  If there are no issues and the transaction makes it to settlement, the EMD will be credited to the buyer as money already paid.  That means it will go to down payment or closing costs.Not every transaction makes it to settlement.  Our contract very clearly outlines what happens to that EMD if the buyer voids the contract, or if the buyer defaults.  If a buyer voids the contract, the EMD is refunded to the buyer.  If the bu...
