Who is Kerrie LaGuardia ?   First, she's a kind person.   She thinks and she acts with kindness.   She loves kindness.   She's mastered kindness.   That's why her smile is beautiful.   She's always asking others' "What can I do for you ? "   She always finds things to say that are encouraging.   She doesn't do things to lower the spirits of others.   She finds ways to raise their dignity.   I believe that even if Kerrie isn't feeling very kind she'll find a way to overcome that feeling.   Kerrie listens to those who need a listening ear.   Listening is one of the greatest acts of kindness.   Kerrie is empathetic.   She's compassionate about her work.   And she's not a "bad news broker".   She learns from everyone.   And she believes in the welfare of those around her.   She believes tha...

Some things about Tennessee:   First, I love my Tennessee backyard !   The city of Kingston served asTennessee's state capital for one day (September 21, 1807) as a result of treaties negotiated with the Cherokee Indians. The two-hour legislative session passed two resolutions and adjourned back to Knoxville.   Andrew Johnson held every elective office at the local, state, and federal level, including President of the United States. He was elected alderman, mayor, state representative, and state senator from Greeneville. He served as governor and military governor of Tennessee and United States congressman, senator, and vice president, becoming President of the United States following the assassination of Abraham Lincoln.   Iroquois, bred at Nashville's Belle Meade Plantation, was the ...

Here's a blast from the past ! Dennis Quaid & Alec Baldwin "Great Balls of Fire" Filmed in Memphis in 1989, I bought the car that Alec Baldwin drives in the film from the producers when production had completed. It's a light blue 1949 Plymouth Special Deluxe. I restored it and drove it for while before I sold it. Enjoy ! -David-

This came in the mail today. ------------------------ Hello, As you may know, the Federal government’s spending authority expired at midnight, Monday, September 30th, 2013.   Therefore, most HUD programs have been temporarily interrupted and most HUD employees have been told they cannot work.   We will not be able to check accounts or respond to questions during the shutdown.         We look forward to responding to your messages when we return to work and regret any inconvenience the government shutdown may cause.

I love my home. It's cozy. Warm in the winter. Cool in the summer. It's in an old Memphis neighborhood. Satiated with crime, racism, poverty, illiteracy, and blight. Somehow or other I've been spared the horror. But not the awareness of it. Many of the homes around me are boarded up. Many abandoned. Some burned, looted and trashed. Some with vagrants. Bank owned and foreclosed.   Here's a picture of my backyard in the winter. You can see how peaceful it is. It's kind of an escape from the reality of the street that's only a couple of hundred yards to the west. Gang violence, drugs, prostitution, robbery, burglary, auto thefts, home invasions, mental illness, hunger, domestic assault and murder, poor schools, bad cops and politicians, high taxes. It's all there. Just on the other side of...

I passed the million marker today.   What I've learned from you is priceless.   Worth more than any points....   My life is better because of you, & ActiveRain   I don't want to burden you with a long, boring, time consuming, epic dissertation, accompanied by a violin player, about why I'm grateful.   So I'll just say,   "Thanks to all !"     -David-

Some only want to play a game and keep score.    To some members it's a game called "ActiveRain". ActiveRain is not a game.   ActiveRain is a network of highly skilled, dedicated real estate professionals.   Most of them anyway.   When you get ActiveRain points it's because of your involvement. Not because of a slam dunk.   So why do some people pig out for points ?   They need and crave attention.   They want to play a game.   It doesn't matter that they post the same listings five or six times for points.   It doesn't matter that they spam the real estate community with email asking everyone to join for the bonus points they get if you join. It doesn't matter that their blog content is boring, sucks and always gets suggested by their toadies.   They just want to win the game.   The po...

#2380 When a broker creates a relationship between himself / herself and the seller this type of relationship is known as implied agency ? Is this true or false ? Take your time. The solution is posted below the wildlife photo. A. False An implied agency is one where the parties will imply that they have consented to an agency relationship, hence the term implied agency. The agency relationship between the broker and the seller is a special agency relationship. A special agency has been created because the seller authorizes a broker to act in the seller's behalf in the transaction.

#2379 When we consider the term fiduciary when we're talking about a real estate transaction we're always talking about the person that has the legal authority to act in the absence of on behalf of another person when signing a contract or making an offer. Is this true or false ? Take your time on this tough question. If you miss it you need to take a refresher course on agency. The solution is posted below the royalty free wildlife photo. A. The above definition is so false it felt almost illegal creating it. :-) A fiduciary relationship is the relationship the agent has to the principal. The principal is the chief party in a real estate deal and the party that the agent is working for in the transaction. When someone has the authority to act for another this is known as the power o...

#2378 When a home was constructed, each room of the house was preassembled at a factory before being driven to and unloaded at the construction site. After the preassembled materials were in place the rooms were wired and fitted with heating and refrigeration vents and electrical extensions. Plumbing was installed. The preassembled rooms are known as converted / mobile rooms because they were assembled in a factory before they were transported to the home site. Take your time. The solution is posted below the wildlife photo. Is this true or false ? A. False Coverted means to remodel a building into something other than which it was originally constructed or intended to be used for. Preassembled rooms in a factory are examples of modular construction.

#2377 A medical building owner wanted to convert the building into residential property and sell individual units in the building once the conversion had been completed. When a building is converted into something other than which it was originally constructed or intended for this is know as modular reconstruction. Is this true or false ? Please take your time. The solution is posted below the wildlife photo. A. False. Modular reconstruction would rely on prefabricated or preassembled materials. Although modular reconstruction may play a part in conversion of the building from which it was originally constructed for, the process of converting the building from commercial usage to residential is know as converted-use.

#2376 Some of the costs and expenses that have to be considered are the recurrent taxes on personal property. Is this true or false ? Please take your time. The solution is posted below the wildlife photo. A. False Personal property is not real estate and is not included in the cost of owning a home. Personal property also has another name, chattels, and since chattels are movable or objects which may be displaced or portable they don't apply to the definition of real property. Property taxes have to be considered in the expenses and costs of owning a home.
