The focus of our practice is civil and criminal taxpayer representation, as well as bankruptcy and commercial litigation.  We frequently have New Haven taxpayers come to our office with a federal tax debt they do not believe they owe to the IRS.   We can tell you that there are many opportunities to challenge a federal tax liability with the IRS, even after the opportunity to appeal has come and gone.  Opportunities for challenging a tax liability include: Filing a timely appeal with the IRS within 30 days after the proposed assessment; Filing a protest with the United States Tax Court within 90 days after the Notice of Deficiency is received (referred to as the “90 Day Letter”); Filing a Doubt as to Liability offer; and Requesting Audit Reconsideration. The keys to both a Doubt as to L...

New Haven Short Sale Agent What is a real estate short sale in New Haven? A sale in real estate, also commonly called a short sale, happens when a lender is willing to accept a lower pay off on a loan than what is currently owed due to the borrowers inability to continue making payments. What does it take to qualify for a New Haven Short sale? While lenders seem to be easier to work with lately regarding qualifications, there are usually three borrower qualifications that most lenders require for a New Haven short sale. Negative Equity - The proceeds from the sale of the property, after all closing costs are paid, are less than the amount currently owed on the property, Financial Insolvency - Financial insolvency means that the borrower has no other assets that could cover the deficien...

The focus of our practice is civil and criminal taxpayer representation, as well as bankruptcy and commercial litigation.  The IRS’s new 2012 “Fresh Start” initiative has made this time maybe the best time ever if you live in New Haven, Connecticut to file an Offer-in-Compromise (“OIC”) with the IRS. We can tell you that in the past it has often been difficult to have an OIC accepted by the IRS.  However, in an effort to both help taxpayers and get its arms around its ever growing inventory of collection cases, the IRS has rolled out a 2012 initiative that makes it easier to resolve past tax debts, including: A reduced window for reviewing dissipated assets; A significantly reduced “future income” calculation for the OIC; A streamlined Offer-in-Compromise program that reduces the amount...

The focus of our practice is civil and criminal taxpayer representation, as well as bankruptcy and commercial litigation. The IRS’s new 2012 “Fresh Start” initiative has made significant changes to the IRS Notice of Federal Tax Lien policy. We can tell you that in the past it has often been difficult to have the IRS withdraw a Notice of Federal Tax Lien without actually disposing of the asset in question.Meanwhile the lien has caused unbelievable difficulties for the taxpayers, including ruining his or her credit and making it almost impossible to obtain any form of financing. However, in an effort to both help taxpayers and get its arms around its ever growing inventory of collection cases, the IRS has rolled out a 2012 initiative that makes it easier to resolve past tax debts, includin...

The focus of our practice is civil and criminal taxpayer representation, as well as bankruptcy and commercial litigation.  There is a common misconception that taxes are not dischargeable in bankruptcy. We can tell you that there are many instances where bankruptcy may be the best option for resolving back federal and state taxes. There are a number of benefits for our Connecticut clients who seek to use bankruptcy as a means for resolving their outstanding tax issues, including: Discharging back income taxes; Forcing an installment agreement on an otherwise unwilling IRS or Connecticut DRS; Discharging other unsecured debts to free up cash flow to resolve the priority tax debts; and Potentially discharging tax penalties and interest. Each taxpayer’s situation must be analyzed, but ther...

The focus of our practice is civil and criminal taxpayer representation, as well as bankruptcy and commercial litigation.  We are frequently asked whether bankruptcy can be utilized to help taxpayers resolve their back taxes. We can tell you that there are many instances where bankruptcy may be the best option for resolving back federal and state taxes. There are a number of benefits for our Connecticut clients who seek to use bankruptcy as a means for resolving their outstanding tax issues. Historically there have been few criminal employment tax prosecutions, however the IRS Criminal Investigation Division has suddenly focused on this area.  The number of prosecutions for criminal employment tax violations under IRC § 7202 has swung up significantly in the last 2 years. We represent taxpayers in a number of criminal tax prosecutions, and can tell taxpayers that the things that the IRS Criminal Investigation Division looks for when deciding to pursue a criminal payroll tax case against a business owner.    Those things they look for include: •       Recidivism: Where the taxpayer has opened a series of companies that fail to pay the employment taxes.  •       Personal benefit reaped by the owner ...

I don't like movie Theaters so I wait until the movie comes out on DVD.  I don't like to go to concerts, so I wait to buy the CD.  But there is a combination of the two that I will go to and that is a Play or Broadway Show. My 38th wedding anniversary is in another 12 days, and for our anniversary my wife wanted to go see The Jersey Boys.  When I heard the price of the tickets, you guest it, I almost had the big one.  My wife knew exactly what my reaction would be, so thoughts started to run through my mine, did she really want to make it to number 39?  After 38 years she knows what to say to get her way, so I agreed and the tickets were order. The Jersey Boys was only here at th Shubert Theater in New Haven, CT until today, and the best tickets that she could get were for yesterday ...

The same crap with lost documents and poor communication as I wrote in my last blog about US Bank. Only difference was this time once the file got in front of a negotiator the person sitting behind the desk was competent. I better go play powerball now, because that was like winning the lottery when it comes to this bank. Anyhow, this particular client was deep in foreclosure. When we listed the property a motion for judgement of strict foreclosure had just been filed, and the prospects of closing this deal seemed weak at best. We were able to get a contract in the first 2 weeks, and quickly submitted all docs to US Bank...again, and again, and again. 3 months roll by and our first buyer walked. We were able to quickly get another buyer, and at about the 130 day mark, we finally got a ...
