At the NAR national conference we had the good fortune of attending a session by Barbara Nichols.  This speaker has written a book on avoiding legal liability in real estate transactions.  Click here for book info.Probably the key item in her session was the concept of proactively disclosing ALL material facts.  Since material facts are relevant to a buyer's decision, it is important to get them out into the sunshine.  So, if you know that the neighbor is crazy, disclose it to the buyer.  If you know of any water issues, disclose them.  She made a big point out of the fact that afterwards it will look really bad if you knew of a fact and did not disclose it, and it will be very easy for the buyer to say that it was material (i.e., "I wouldn't have bought the house if I had known that.")...

There's a lot of talk these days about foreclosures, reos, and defaults. In an effort to answer our client's questions about what was going on in the market, we implemented Foreclosure maps, where we take the current data and plot it on the map. This allows our clients (and us) to visually see where the foreclosures are occurring to better understand the real estate market. People hear a lot about the climate in San Diego, but did you know that the west part of San Diego has FOUR climate zones? Depending upon where you buy a house, there can be substantial differences in your climate experience there, and things like air conditioning can matter in one zone and not another. Here's a quick list of the zones that scientists have identified by looking at empirical temperature and humidity data: Zone Coverage Climate 1. Did you ever wonder why VERY VERY FEW real estate sites have really good lot/land real estate maps? This blog entry seeks to explain the problems and to give you some ideas on how you might solve them. Recently we implemented real estate maps with Lot/Land data pulled from the MLS RETS server. This had been a troublesome set of maps to create, so I decided to share some of my ideas with our colleagues on this. I discovered a new restaurant in Carlsbad today and wanted to share it. I saw an article (actually a recommendation) about it the other day and decided to stop by.Chef Pascal Vignau, of Savory casual Fare fame in Encinitas, has started this new place, along with Chef David Birtness.The El Camino Real Grille is in the La Costa Town Center at the corner of El Camino Real and La Costa Avenue in South Carlsbad (7740 El Camino Real, Suite F - the former Red Dahlia Restaurant). Carlsbad has gone to the dogs, and the cats. And not just Carlsbad, either.Pets, especially dogs, seem to becoming more popular in our area, and retailers and other service providers are responding. And people carry their pets (well, at least the small dogs) everywhere.Does Fido need a place to romp at the beach? Many of the beaches allow dogs at certain times of the year, OR you could just go to Dog Beach in Del Mar (at the north end of town, a.k.a. North Beach). This is dog heaven at the beach. No reason why you can't take Fluffy, too, though somehow cats don't seem all that enthralled with the beach like dogs are. Or visit the Humane Society's public dog park in Encinitas. I have mentioned a number of times about how dedicated Carlsbad is to the arts. Carlsbad IS a town that is fond of the artworld, and there are plenty of venues and activities during the year that illustrate this attitude.Art Splash, in September, is one such outdoor activity. I have been out looking at homes these past few weeks. My buyers are amazed at the deals out there right now. Combined with the recent drops in interest rates, you can actually get some tremendous deals. Many pencil out as break even or small profit rentals, with only upside growth potential. The high end luxury market is our fastest moving segment. The wealthy are swooping in paying cash for multi-million dollar homes in some of the most exclusive locations.
