Lis PendensA lis pendens (also called a pendency of action) is a recorded notice that indicates pending litigation affecting the title on a property. It clouds the title, preventing the sale or transfer of the property until the lis pendens is removed, the action is dismissed, or final judgement is rendered. A pendency of action gives the least protection against a mechanic`s lien. Attachments An attachment lien or writ of attachment is the process by which the court holds the real or personal property of a defendant as security for a possible judgement pending the outcome of a lawsuit. An attachment lien is an involuntary, specific lien which is valid for three years. It does NOT terminate upon death and in certain cases may be extended.
