The entire premise = that consumers were forced to spend more money than they had to sell their house - is just ridiculous to me. 
They had EVERY opportunity to say no and sell their own house, hire an attorney to advise and many other options.
Whiny lil bitches and attorneys making bank off them. LOL

This is going to sound ridiculous but, hear me out...I'm so glad someone from a state who has ALREADY done their due diligence by drafting forms that address these issues for their agents & brokers to use is one that is being sued.

The copycat litigious complainants are in for a rude awakening in GA and hopefully, this will stop others who are considering filing suit in other states. NAR did such a terrible job defending Missouri's suit but, I also think that they were missing the critical piece that GA has in their listing Contracts - an explanation of how BAs are paid (by the LA's brokerage). We have the same here AND also an explanation in the BA forms pertaining to that as well.

Lastly, I truly believe that, as a whole, we could have avoided this by being better educators. As brokers/agents, we have a full understanding of how the BAs are paid and it is our job to convey that to our sellers (and buyers). We need to teach to the extent that our sellers can teach someone else about the Contract(s) that they just signed. As a seller, when you understand that YOU HAVE the option of paying a buyers' brokerage through your LA, and thereby increasing your buyer pool, you are going to want to pay your LA to cover the BA also!

Thanks for sharing, I had not heard of this one.  In California we have contracts that have stopped one of these lawsuits already.  We have the SOC as part of the listing agreement as well as a section for opting out of the MLS.

Thank you for alerting us. Because I'm neither a judge or an attorney on the case, I have no control over it, I just have to deal with the results.
I'm focused on dealing with my business and the CA news and National News that affects CA directly.
If I can't control it, vote on it or prepare for it, I'll deal with it when it becomes "a thing" or a law. In the meantime I'm closing deals and living my life on a news diet.

We will certainly watch to see how this lawsuit plays out. In CT, the state is making ALL agents review a brief  "anti-trust" video; it's mandatory.

That article does not describe what I do as an agent. I think that's where the public is getting things confused. As Candice said, forced to spend more money? If buyers HAD ANY money, they could pay their agent but that's not how things go in the real world.

Yes, several states are seeing "copy cat" lawsuits. Although, one is representing buyers. We have buyer agency documents and break everything down. From what I understand, so does Missouri. We really need the original lawsuit lost in MO to be appealed and turned over. 

In the meantime, it will be interesting to see if some of these companies settle for millions again and again.

Homeowners have many options when choosing how to sell their house.  They can pay as little as they wish to sell.  They can be a for sell by owner as well.  The public doesn't understand that having the Multiple Listing Service alows them to list their house and have it seen by all agents and companies and buyers are allowed to see homes that otherwise wouldn't be available for them to see.  Lawyers love to form class action lawsuits.
