I guess this is why in Texas, we are required to explain representation and need to provide parties a form called IABS (Information About Brokerage Services). Which explains who represents who in the transaction and what that agents' duties are! 

PS - no where on that form, does it state it's OK to lie...

I see two issues-- Fraud in the inducement and tortious interference with a contractual relationship.  

Does it happen in real life?  Sure, almost every Realtor I know, it seems, has had it happen to them and their client.  My memory is good.  I remember who the bad eggs are.

Anyone can lie and some people will interfere with a relationship in progress with no second thoughts. In Utah, until a buyer signs a Buyer Broker Agreement with an agent, that person is a customer, not a client and like you say, can get poached by other agents.

I wouldn't do it & many have listed great reasons. I just consider that buyer 'taken' & let that be the end of it. 

No poaching zone is how I look at it.

If the listing agent is informed by the buyer that they have an agent, the listing agent should be respecting that relationship. That wouldn't preclude the listing agent and the buyer from entering into a future agreement, say, to list one of the buyers other properties if the agency is only for the purchase.

I find these situations to be not worth my trouble. I can't even tell you how many I have sent back to their agent!

Consumers may come and go, we may form relationships with some, others we may never see again. But we also have relationships with our colleagues, and memories are long. We have to watch how we treat people and that means staying in our lane.

Any one can lie. Whether they should lie is a whole other story.  A buyer who is working with an agent with no exclusive listing agreement at the end of the day can be considered "fair" game. Such a buyer is not a client of the agent. Why would you invest time in a buyer who isn't willing to sign a representation agreement with you?

Whether the agent in question is, requires much more data.
If they are and you have proof, there are established processes to follow.
Will you be satisfied with the outcome, most likely no.

If you have made it clear to the listing agent that you are having another agent represent you as the buyer, written agreement or not, it goes against our Code of Ethics as realtors and is punishable if a complaint is filed and listing agent is found guilty of doing so. Also, a realtor lying to you in any way is not okay. There is certain information we are not allowed to disclose, but lying is never appropriate.

Wow jane miller that's getting right to the point.  A listing agent should never lie to a buyer whether they have an agent or not.  On more than one occassion I have had to explain to a client that my job does not involve lying for you.  It's just not worth putting my license on the line.
