Because plenty of people seem to buy a lot of hot air from our elected officials? All kidding aside kennith Frazier In all my years as a Realtor, salesperson, Broker/Owner I've never heard of air rights being sold in the City that I live in, or even in the State for that matter.

His point was let's get back to the basics.  Don't get fancy. As a real estate student, I wouldn't worry about air rights.  Learn the basics first.  Stick to your lessons.

The seller would literally be "taking wealth from the air", a phrased coined by the engineer William J. Wilgus. The legal concept that "whoever owns the soil, it is theirs up to Heaven and down to Hell" was well and good before air travel!  Since then , the federal government has put limits on air rights. Air rights are property and can be transferred or sold and are an especially important part of real estate in urban areas such as Chicago (https://www.chipublib.org/blogs/post/technology-that-changed-chicago-air-rights/) and New York (http://www.airrightsny.com/). Good on you for thinking about air rights!

You may have to ask yourself what you will be selling... properties or air? I would imagine that "air rights" could come up around airports but I've never had an instance where this came up.

I would seek guidance from an attorney if someone asked me this question as a real estate agents. Air rights are sold with the real property beneath so, to separate the two would not be something we could speak to on our own as agents.

One of the latest deals is where a train yard in manhattan sold the right to built skyscrapers over top of the rail yard. A whole community will be built while the train yard remains doing what it does, only now it will be underneath the buildings. I would love to have a piece of that one.
