I never worried about legal liability.  I kept up on current regulations, did the right thing and paid E&O insurance. 

As for industry concerns, I'd say fraud and scams.

We do the right thing, but wire fraud is all over the news and happening around the country. We have E & O which had a cyber security endorsement added to it this year, but this is really hard to control.

Lack of disclosure. I would rather lose a sale or a client than live with knowledge that a client willfully hid a material fact from a buyer in order to achieve a closed sale. The buyer will find out and there will be a price to pay.
