Just like lenders check the Federal data reports to see if there is debt owned on child support and overpayments. I for one am glad they deep a little deeper. These are debt that should be paid and if the buyer doesn't have the money then they should wait to buy until these are paid.

That is why I work with a lender who completes full due diligence upfront. However, if others, like title and escrow are not, something like this can still show up prior to closing.

Yes, this is a concern of ours as well. Borrowers should know about any liens or judgments against them but sometimes they say they don't have any. I am questioning my borrowers twice about this when doing their preapproval to try and make sure we don't have a problem later. The lenders already have the thirs party investigators checking on all kinds of things.

I'm a broker, and we do a lot of our homework like this upfront, but some of this doesn't come up on our searches until a third party working with the lender finds it.
And you can't depend on the buyer to tell you they have liens and judgments. Many of our clients don't even realize they have them.
