If you're not a licensee, you can transfer the home between family members without one. If you are, however, the transaction may need to go through your brokerage, most likely.

You hire a Broker so you don't have to ask "How do you go about it"? Always hire a broker.

I've seen people fail in a variety of ways, like:

  • it doesn't sell
  • it sells for less than they could have got
  • they pay more than they should have
  • it takes longer to sell because the marketing is not good
  • they purchase a property with clouded title from outstanding liens
  • they miss repairs, maybe big ones, that I could've pointed out prior to spending their money on an inspection
  • and the list goes on- Experience Matters

  I met my brother at the Courthouse with a deed to some family property that I was transferring to him.  We had the deed notarized and witnessed and recorded right then and there.

A real estate transaction can be as simple as a handshake and recording a new deed with the appropriate authority, usually the county.  But, keep in mind the transfer of real estate is a legal transaction. There may be local laws that may be applicable.  Also, real estate transactions are usually one of the largest financial transactions a person may ever make. Doing it wrong will only cost you big time.

Real Estate Brokers are experts. Their job is to protect the consumer and make sure everything is done legally and appropriately.

Anyone can sell anyone else a property without a real estate agent, but they would need an attorney or title company to complete the transaction, I would imagine.  You never need a broker as long as you don't represent someone else in a transaction. And how it would go would depend on local or state laws.

If the home is being sold from one family member to another and neither party wanted to use a real estate professional, the entire transfer could be handled with an attorney. That being said, both parties really need to know what they are getting into/doing, to make sure both get a fair deal.

You won't know you ran into a problem until after closing.  Always better to have a broker who knows the business, rather than save some money upfront.  Could cost more, after the fact.
