In my area, Treasure Coast of Florida, it is rare to have a post closing occupancy. Most of my deals provide occupancy at "funding".

In Illinois, a holdover by the seller is common. In Florida, closing changes possession. Location, location, location!

California - COE is common on vacant houses.  COE +2 for occupied or staged houses to allow for moving time.

For many sales in San Jose, CA and the entire San Francisco Bay area it is common. It is also expected that the seller will not pay to stay and occupy for an additional 30-60 days. This has been happening for years. 

      Day of Closing = Day of Occupancy. 

     I am in Tallahassee; I have also been a Board member of OMCAR (Ocala), RASM (Sarasota), OCAR (Orlando).  I have closed transactions in other Florida towns and cities.   It's the same everywhere in Florida.

     Buyer occupy prior to close, or Seller continues to occupy after closing, can create a legal nightmare.  If you absolutely have to do it, have a lawyer draw up separate lease documents detailing insurance, liability, etc.

Common?  Typical? Usual?   The practice can and does vary by each individual transaction and the parties involved.   It's important to know and understand the practices and documents involved in your area.  That's true in my Los Angeles County area of California as it is elsewhere.  

New owner takes possession of the property at closing in Atlanta.

Here in Miami you get the keys at the closing table. I have never had a PCO. 

In Cody, Wyoming we typically take possession at closing.

We see it on occasion - especially in this market when sellers are having trouble finding their next home - in Charlotte but, it's not 'the' common practice by any stretch of the imagination!

No, not in Charlotte. Sellers virtually never occupy the home post-closing. Typically they are moved out the day before.

We have table funding in Oklahoma so once all monies are received title transfers. Possession is a separate part of the contract but typically same day.

In Bucks and Philadelphia area the buyers and sellers meet at the settlement table and when it is completed the buyer owns the home and the sellers have all of their belongings out of the house.  It is rare for the seller to stay after settlement.

In the Atlanta, GA market, possession at closing is common practice. 

Post closing occupancy is not common in our area.

I'm in Massachusetts.... the day of occupancy is typically after the documents are signed and prior to recording the deed!!  that's common practice...however, I have builders who will not give the keys unless the deed is recorded and he has the proceeds!! we close those at the Registry of Deeds.... most resale homes will allow the buyers to begin moving furniture in after the closing and prior to recording ( and recording happens within a few hours.)

NW AZ = pre- and post- possession are relatively rare, require additional paperwork and disclaimers. Typically, property, keys and possession are transferred at Recordation/COE.

Once you close in NY's Capital Region, it's yours unless a rent back agreement (which attorneys typically hate!) has been agreed to prior.  

98% of the time, possession in Clarksville TN is given at closing.

I very seldom see a occupancy other than right after closing the same day

In the Phoenix area, we frown on Pre and Post Possession. Too much liability, too many things to go wrong. It does make it a little more complicated if the seller does not want to leave until closing. I have literally had sellers going out the back door while the buyers were coming in the front door.

CT - no, sellers move out by closing day. Occasionally, permission is granted with a legal document for a slight extension. I don't favor the practice.

Mississauga, Ontario (a suburb of Toronto, Ontario) occupancy usually takes placing on the completion date. 

It is not - in most part of Eastern MA.

No not common place I would say it happens some but rarely in the N. Virginia area

We were one of only a few states that kept a practice of the Seller having 3 days in the home after closing until 2-3 years ago.  Now, we all TRY to get possession day of closing, but many times a post closing agreement is needed.
