When there was a typo on a contract where instead of $299,900 it was written $99,900. There was already an agreed to sales price on a contract with nearly 10 cross outs, counter offers and such. A new contract was written to clean it up when the typo took place. The seller did not catch it, the buyer did and demanded to buy it for 99,900 taking it all the way to court, losing, but costing tens of thousands in legal fees

It wasn't actually a dispute. Buyers were referred to me and they wanted to buy a town home. We spent a day looking and they wrote and offer and were highly qualified (prequal in hand). And then they disappeared - I never heard from them again. I had a counter offer in hand.....with no buyers. It was bizarre. The folks that referred them felt so bad - but how could have they knows the folks were odd. Listing agent was bummed but there wasn't much I could say......so sorry - they vanished.

When I am on the Buyer's side, I use pre-printed contracts and forms that come from our Board or Association. I don't write in extra clauses that will cause confusion. When I am on the Seller's side, I won't let my Seller accept contracts that contain conflicting or confusing clauses.
Sure, I've had parties walk after inspections, I've seen "pre-approved" buyers get denied their loan, etc. but those are not contract disputes per se.

We add clauses (yes - in AZ it is permitted for real estate agents to draft real estate contract language) that makes things "crystal clear". Of the dozen or so Buyers who "behaved badly" after going into contract with our Sellers, they all forfeited their earnest money. That was the decision of the Title & Escrow company, based on the language in the contracts....
