Now that sounds extremely frustrating. So the buyer made a deal, then sent a contract for a lower amount with an out-of-town-agent that hadn't been involved so far, and wants 30 days to come see the place and decide if he wants it? Most sellers would say !)(&*@#)(*&!@)#& no.

IN todays toxic and dangerous 'email attachement' environment, with a source unknown, it would never have been opened. 

However, the chorus sings from the choral pit of real estate agents that all buyers should have their own SEPARATE representation. It disappointing but an eventuality you should anticipate and welcome....HOWEVER....

What I WOULD do is explain I will NOT assume the responsibilities of the buyers agent. No, I don't know how they are going to get that lockbox open. So. let's negotiate. You are aware this buyers agent intends to return to the buyer the majority of the compensation taken from you.

This is wrong on many levels!   I don't even know why Designated Brokers allow this to happen.  It is a huge legal liability to the agent and agency (allegedly) representing the buyer... among the other more obvious issues.

I advise my clients to not accept contracts from folks who haven't seen the home.  As for showing it to someone else's client, if it's that far away, I would ask for a referral fee.

Stuff happens.   Is this your listing?   If so, your obligation is to the seller to sell the property.  If it's not your listing, it may matter if you have a buyer-broker agreement, the laws in your state and/or simply another learning experience.

I have heard about this last month, Andrew Mooers . I was at a state association meeting and a Broker on the Oregon coast expressed frustration from Portland agents sending clients to them with the instructions to NOT tell the coast agents that they have an agent already, get the listing agent to open the home, show them, work with them, and at the point they are ready to write, the Portland agent would write up the offer. Very underhanded and pushing the ethics envelope.

Andrew Mooers Ask for a referral fee for doing the Agent's job. Should have had an agency agreement with the buyer. A BBA would have locked them in should another agent mysteriously appear.

oh, I think that's happened to many.... we're listing agents and we never worry about that....it's better to have a buyer's agent sell the property....we are always listing agents and that buyer would have no representation....and they are always told that...

  • assult the agent?
  • demand a referral fee?
  • offer a $1 co-op fee?
  • not show the property unless the buyer signs an exclusive?
  • seriously????

I am not condoning what this fake buyers agent is trying to do...however some seem to forget that their job is to HELP the seller sell the property...AFTER ALL, DOSEN'T EVERY LISTING AGENT MAKE GRAND PROMISES TO THE SELLER TO GET THE LISTING??

I share in your annoyance and frustration over this dishonesty. Cooperation and compensation are two different things. You're only required to cooperate. That agent's not in your Association, correct? Submit the offer to the seller with an admonition that this offer binds only the seller for 30 days. Then inform the buyer's agent that the the co-op fee for this property is $1. LOL

This never happens when you get a buyer/broker.

If you'd get a listing agreement, a buyer/broker is the same principle and effort.
