I think everything we put in writing should be carefully considered with the assumption that in the future, this document may be part of a lawsuit.

I do not text my clients with any type of confidential information.  Texting is not use for that kind of communication in my business.

I've never heard of this app, Jerry. Then again, I also don't text highly confidential, critical information. I don't consider that something that should be texted.

I think it's important to let clients know about the risks of sharing personal information either by email or text! Some things need to be verbal, or secure in some other way!

Texting is just like email in that any sensitive or personally identifiable information needs to be protected and encrypted by the sender. This is an area where more education needs to be done to protect agents and their clients. I'll be writing a blog post soon about information security as it relates to texting/emails and why it's important to be able to archive both and have them ready for e-discovery if you end up in court. Even though texting may not be acceptable in some states to create a binding agreement, that dooes not relieve us of the responsibility to protect and produce our communications when it counts.

LOL!  Yes, that was always a big concern in the corporate world.  I have some wonderful war stories from when I worked in the hospital space.

Never heard of it. The common sense rule is if you do not want anyone else to see it, do not type it, whether in text or email. 

You can never be too careful when it comes to confidential information.

What do you do with email, twitter, facebook, or face-to-face communication? The only thing we can do is educate.
