Good question. It's not legal here yet but it's coming fast. I personally don't want to work with stoners even though you can 'spot' them a mile off.

In office policy/procedures manuals you may start to see clauses addressing this. Mine basically says you have to behave when representing the company which is basically anytime you're in public. It's no better or worse than alcohol. If you can handle it you handle it and if you can't you shouldn't.

I have a rescue chihuahua, that came from a "pot house".  Her personality is flat from being "stoned"...same with people.

I had an agent that was a weekend smoker and he worked a rental client...he rented the $2500 a month house for $3500.(yes, $1000 MORE) I fired him.

What broker needs the liability of someone with a fuzzy head?

I'm sure brokers will have some claus regarding the use of marijuana. Not much different than using alcohol. I don't want to deal with agents that are impaired either way.

As Roy Kelley said, but I would argue that since the agents are considered independent agents and not employees, there exists a bilateral mutually beneficial agreement and if the broker feels the liability outweighs the benefits, then that is a choice that should be made and leave it up to a disgruntled agent to test in the Courts.

Can I assume that you are talking about after hours use? Of course my office wouldn't allow it to be smoked on the premises. Although we have served beer and wine at the office. 

Our office policy doesn't have anything in it that addresses this issue. If someone is a casual user, I have no problem with that.

If someone is a stoner, I don't think they would be able to get their license, and if they already have one, I think their time in this business would be short lived. That would be due to a pending lawsuit for screwing up, or lack of business due to being stoned all of the time.

It is illegal here but now legal to the South in MA and Northeast in ME. I dont know what will happen but being impaired is being impaired and has consequences in work and driving

I have no idea what the agents in my brokerage do in their free time, nor is it my business. We don't work with buyers looking to purchase for marijuana use - and many brokerages are doing the same.

Of course they MUST make dismissal a policy for those who are OVERT breaker of federal law. However, the reality is the prevailing rule will be 'don't ask/don't tell.'

Those who embrace an entitlement empowering them to encroach on others will find themselves shopping for a broker OR passing it to the boss.
