In office policy/procedures manuals you may start to see clauses addressing this. Mine basically says you have to behave when representing the company which is basically anytime you're in public. It's no better or worse than alcohol. If you can handle it you handle it and if you can't you shouldn't.

I had an agent that was a weekend smoker and he worked a rental client...he rented the $2500 a month house for $3500.(yes, $1000 MORE) I fired him.

As Roy Kelley said, but I would argue that since the agents are considered independent agents and not employees, there exists a bilateral mutually beneficial agreement and if the broker feels the liability outweighs the benefits, then that is a choice that should be made and leave it up to a disgruntled agent to test in the Courts.

Can I assume that you are talking about after hours use? Of course my office wouldn't allow it to be smoked on the premises. Although we have served beer and wine at the office.
Our office policy doesn't have anything in it that addresses this issue. If someone is a casual user, I have no problem with that.
If someone is a stoner, I don't think they would be able to get their license, and if they already have one, I think their time in this business would be short lived. That would be due to a pending lawsuit for screwing up, or lack of business due to being stoned all of the time.

Of course they MUST make dismissal a policy for those who are OVERT breaker of federal law. However, the reality is the prevailing rule will be 'don't ask/don't tell.'
