Fred, there are now, have been, and will continue to be illegal marijuana investors and growers.  It is not just the investors. There are huge issues with the medical cannabis industry because of the great divide between Federal and State. It is driving an underground cash economy and a crap ton of taxes are not being paid. Meanwhile, Big Pharma is making a Killing on drugs that are literally killing people.

I am neutral as far as pot goes, but do feel that the feds really have no business in this state issue and congress needs to tell the dea to spend their resources on a more important endeavor.

All disappeared when those on high passed judgment. However, it did not prevent a whole lot of people from making a lot of money.

What happened when the 'pill mills' were shut down? A heroin epidemic swept the country. The money IS going to flow, why not bring it into the daylight where is can be taxed, " TO SUPPORT OUR SCHOOLS OF COURSE!"

At this moment, if the purpose of the purchase is disclosed, it compels it become all cash transactions. (I.e. the banks can not sell the loans to the taxpayer).

It will be interesting to observe should the feds take action, deport illegals, imprison city leaders who support sanctuary cities in DEFIANCE of FEDERAL law,  and banning this emerging 'smoke it' movement and see which brings the biggest crowd to the Capital Mall.

Here it's legal to possess it and grow it, but you can't sell it.  So some enterprising condo builders are offering a "grow closet" with all the lighting and water.  It wouldn't be on the top of my wish list!  I destroyed enough brain cells in the 60's.

If an agent sells farms or agricultural land  in California right now, there is a good chance it will become a legal pot farm in the future. Any plants on it would be considered "personal property" just like corn or whatever.

Yes I am in the mix on this...It is very fascinating and being defined as we go. Fed law can come in and shake things up anytime it wants to for now but they need to have a prompt to do so. Meanwhile, local law prevails. The new Attorney General will direct this I bet....

 Fred Griffin - in Oregon we are a year ahead of many states regarding how we as real estate professionals handle marijuana grow operations and buyers who wish to purchase with this intent. I wrote a blog about this early October - Is Your State Going to Pot? Within my brokerage, we have made the decision not to work with people purchasing with the intent of growing or dispensing pot.  Our E & O does not cover federal crimes.

When Prop 203 had just passed (medical MJ) I was flooded with wannabe dispensary owners and I shooed them all away after getting educated on the process. Until it's off the controlled substance list, it's a risk. PS. Is 'Federal Law' the mother of all oxymorons? LOLLL

Investors are going to slow down for the next few months until they see how the next administration handles things. That is the reality when federal law is not enforced, yet conflicts with state law. I know people who have had dealings with these types of investors and have not worried about their legal risks. I don't envision the DEA coming after a real estate agent. That said, I entirely understand why someone would pass on that client.
