Rarely is the HOA information available before an offer is made.  I require all buyers to get an HOA document review.  If they do not agree to get that ... I do not agree to represent them.

Our MLS has HOA fees placed in the listing so buyers know how much the home will cost with the HOA dues before they write.  The deal allows for termination based on review of the preliminary title report and CC&R's, Bylaws. If a buyer wants to know about the HOA prior to offering, research can easily be done to provide these documents for the buyer's review, but rarely does this happen.

As the buyer's agent I may not(likely not) have any yet alone all HOA information unless the listing agent orders/makes it available prior to offer submission. When discussing any HOA details I will cite the source of information:  HOA fees are $xxx.xx per month per the listing agent's remarks.   Even the number of units shown in the mls needs to be verified let alone any other details.      

As you know in California, our purchase agreement addresses this issue and this becomes part of that first discussion who may be considering a properyt within a HOA.

Only if there is something about the association that is pertinent to their needs.  I usually give the HOA information 14 days so if the buyer needs to get out of the contract, they are able to within that time frame.

     The Seller must provide a written disclosure per Florida Law; most LA's put this disclosure, plus the Covenants and Restricitons, in the MLS Associated Documents.

Absolutely, our MLS asks for this information when listings are input into system.  The PAR contracts also request this information or give buyer the option of including contingency to make contract contingent on receiving and approving HOA and or Condo docs if applicable.

Many times you just cannot do that because the LA doesn't provide it or the seller doesn't have it. Our contract says 5 days must be produced for attorney & buyer to review.

Hi Hella - The annual dues are part of the listing, but we may also have covenants in our files, and if we do, we'll provide them pre-contract if the buyer wants them. The full HOA package is part of the title work that is usually provided about a week in.
