     The other day my Seller got hit for the $450 you see in the example.  She was not happy, even though she had been warned.

     "I have always paid my dues in advance... how dare they charge me for this!"

Every Condo development in my area has this and our Sales are conditional upon the Buyer's lawyer approval of same.  We no longer call them that; they are known simply as Status Certificates here.

New 2017 Estoppel Reform Bill:

Property Debt Research’s standard HOA Estoppel letter service fee in Florida is $85 per association. Charges above that amount are charges from the HOA or management company and may include attorney's fees.

Due to complaints from Homeowners, Title Agents, and Real Estate Agents in Florida, the Florida legislature recently passed HB359/SB398 to cap charges and improve response times for HOA Estoppel letters.  The new Estoppel Reform Bill went into effect on July 1st, 2017 and hopefully will improve the process and limit charges from management companies and HOAs.

Key Highlights of HB483 / SB 398 include:

·         The fee cap for owners that are current on their assessments is $250

·         If the owner is delinquent on assessments, an additional charge of up to $150 can be charged

·         If a Rush is required, a charge of up to $100 can be added for delivery within three (3) days

Closed a property today with an HOA and had to have one of these and of course there was a fee associated with it.
