I have listed and sold several row houses but I am not familiar with 'Declaration of Easement' as each unit maintained their unit. There are no CC&R or HOA for any row homes in Erie that I am aware of.

What's the question? In the mortgaeg world I have closed hundreds of home located in the city,where many homes are ROWS. Most will go FHA and Conventional. The appraiser can easly get values based on sales. Not a real problem.

We have a similar thing in our downtown where buildings can be wall to wal or even share a wall. Just off our main street are row home sthat were homes to the mill workers in the 1800's to early 1900's. They are all brick and share a wall. They call it 0 lot lines as well.

We deal with many easements and common areas on sales. Many times it is just put into the deed and you have to make sure it is clear and outlines respnsibliities. There are times te attorneys have had ot clean it up before we could have a closing.

This is a photo of the row houses in question. Sorry I didn't post this when I posted the question. The subject property is the one in the middle. If you look closely you can see that unlike most traditional "ROW HOUSES" there is a 6 foot space between each home allowing for a walk way from front to back, trash container storage, outside shower, flower beds and landscape on each side.
The issue is the legal access that each homeowner has to inspect, repair and maintain both sides of their home albeit only the side to the left of each home is allowed for each homeowner ingress and egress. There is also a garage door leading out to the left side of each walk way.
The issue I'm having with the homeowner on the right is the foilage and flower beds that are up against the subject home. The home inspector noticed that bedding soil had been added to the point where it is actually coverying up the weep screed and he saw signs of rust and deterioration caused from this.
Albeit the Declaration of Easement does explicitly allow each homeowner the right to inspect, repair and maintain both sides of their home the homeowner will not allow us access as is delineated by the DE.
Once again I'm not asking for legal advice. I'm just curious to know if anyone has had any first hand experience wtih this type of situation and how they were able to handle it.
