I don't know that we need more regulations, but if a home is a smoker's home, I wouldn't mind seeing the listing agent disclose the fact in agent comments in mls... so we don't waste time showing properties that we know our buyers wouldn't select.

I tend to agree with Nina Hollander .  Non-smokers certainly know when they enter a home whether it has been smoked in.  But, from a "wasted time" standpoint, I think it would be in both parties best interest to have a comment on the listing.

I typically think, as a non smoker, you'd know right away. But, I'd need to think about the "requirement" aspect. I think it's great if they volunteer and info that keeps them out of court; not sure this is in that category though?

Roy Kelley If they, or they allow others to, to smoke in the home so that the odor is noticeable, I think it would be very useful to have that as a mandatory disclosure, if only to avoid wasting the time spent by buyers who show up to the door and immediately say "pass"!

Even in California with our many disclosures, it's not required yet but as a non-smoker, it's readily apparent when you enter most homes that there is/has been a smoker on the premises.

That is a great question for the BUYERS agent to ask the listing agent if the buyer has those sensitivities. If agents rely on a call center that become more difficult.

Some folks have noses that detect imaginary issues. But there is not arguing with a nose.

In my expereince, most objectionable odors in the home are sourced to cooking or lawn and insect chemicals in the attached garage.

I can smell that the minute the front door is opened!!   I can smell it on clothes and furniture when I'm in the house....they need to deodorize furniture....

Yes!  It is a personal habit, but the smoke gets into the walls and can be difficult to get out of a house... especially if they were a heavy smoker.  Given the health concerns, I think it is right up there with lead based paint.

A smoker doesn't have the sense of smell to determine the negativity which exists but a non-smoker can readily identify its presence. Ozone treatments work fairly well along with repainting, carpet removal and a general professional cleaning. We see it from both sides whereas a customer might not.

Absolutely! I am horribly allergic to tobacco smoke, so I would want to know it's been seeped into the walls for years and would not buy the house, because of it.

I think it is pretty easy to tell, if listing a home and it smells like smoke a lot maybe ask the sellers if you can mention it on the MLS to not waste anyones time looking at the house that can't stand the smell of smoke? Though I can see a downside to that also, but it should not be a mandated disclosure, dont come to many homes that have people smoke inside anymore.

It will be obvious to all that enter.   But it is always a good idea to disclose ALL MATERIAL FACTS, let the buyers determite which (if any) they are concerned with.  I know there are company's that specialize in getting the smell out.  However, it is not inexpensive and I can still smell it, even after they are done.   It is also easy to find another property that does not have smoke.  I feel the same way about mold, replace the work smoke with mold and I give the same (free) advice.
