David Jain - Sometimes sellers accidentally check the wrong box on the TDS.  It happens.  It shouldn't, but it does.  Ask the agent to get written clarification for you from the seller.

If you accept a  property with no permits (which can be a code violation in itself) and you go to sell the property to a buyer with a good agent that does their homework, you may be responsible for bringing the propety up to current code...not the code when the rooms were added, but todays codes.

Did they just pull permits, or where they actually closed out?  Don't rely on an agent that is not representing you.  Hire an attorney to scrutinize the additions and any possible code violations. The attorney can also renegotiate the contract if necessary.

You need to know exactly what your libiality is before you close.

Your best bet is calling a real estate attorney as you have not buyer agent helping you.

Good morning David. It most likely will be a problem during the mortgage process. An appraiser will most likely check out this kind of information during the process and if there are no permits for finished space, that is where I see the problem.

I'd ask that question to your attorney....I hope you have an attorney, because you don't have any representation from that agent if the agent represents the seller.... you're on your own....you certainly need an attorney ....
