Yes I use one, and no, I've never had to enforce it.  I wouldn't even attempt it:  a) think of the cost involved b) think of the negative publicity it would generate c) not to mention a continued negative focus which would impact my other business d) if someone doesn't want to do business with me, I would thank them for raising their hand early before I spent too much time/energy/effort with them.

If they don't want to do business with me, I would be happy to release them and I would wish them well.

Nothing good ever happens by holding onto a negative situation for a moment longer than is absolutely necessary...

Yes and yes. The buyer agency agreement is a legal document signed by you as a representative of your company and the buyer. However, at the end of the day, if a buyer decides they really don't want to work with me, I'll release them. You can't hold buyers hostage.

I use one but will not enforce it. I think the litigation would be unpleasant and useless.

Yes there are times when an exclusive buyers contract is something you will thank yourself for getting, especially in higher end real estate transactions where huge commissions can be on the line.  You can always create a custom arbitration addendum so that you do not end up in an expensive and time consuming litigation if the contract is breachec.  My high end real estate buyer agents don't do business without these contracts in place.  They feel their time is valauble and if you want a dedidicated loyal servant, you need to agree to the commission and the reprsentation.  Just like Beyonce is not going to do anything without having a contract in place.  When you exude the confidence and take control of the relationship buyer's will respect you for that.  In my opinion, you have to wonder about the buyer's that refuse to be bound by having just one agent assist them.
