Having been an expert witness for the past 20+ years as well as a general contractor and real estate broker and developer I've been involved in dozens of non disclosure issues relating specifically to drainage, mold, leaks and myriad water related issues.
Albeit the homeowner is not always held responsible they often get dragged through the mud and have to hire an attorney to go to battle for them. If it can be proven that a homeowner had pre existing knowledge of an issue like this they could end up with a judgement against them that could be qute costly.
How can you prove that the homeowner had knowledge? When you are dragged into court and opposing counsel demands any/all credit card statements, bank statements, personal records, inspection reports etc. it can and often does come out at that point.

I think if you are not ready for rain and disclose it in your property information questionaire, you're not likely to get into trouble. And that goes for all bad maintenance issues.
