Sellers and buyers always have serious legal questions in a short sale.
It is against the law for a real estate agent who is not licensed to practice law to dispense legal advice.
Even if the agent knows the answer to a legal question, a real estate agent is not allowed to tell you.
A lawyer meets that qualification.
An agent does not.
Banks don't always release sellers from personal liability.
The deficiency judgement substantiates this fact.
Banks might be able to legally garnish a seller's future wages, attach bank accounts and pursue the seller for the money.
An attorney can assist a seller with legal means to undertake asset protection.
A real estate agent cannot.
